Appletree Realty Trust v. Massachusetts Department of Transportation

 

This eminent domain case was tried to a jury in Plymouth County in May of 2022. The property owner presented evidence that the taking reduced the width of an internal driveway that prevented access to a portion of the property. The loss of access resulted in the loss of tenants and consequently decreased the fair market value of the property.

The jury heard all the evidence over the course of five days in Court and returned a verdict of $227,000.00. The Defendant previously paid only $28,000.00. The final result was judgment in favor of the property owner in the amount of $214,000.00
